Missing Pen

I bought a pen from 'Pens for Sale' on this board (15/1/13). The pen has still not arrived and the seller is aware of this. Thetracking info hits a black hole this side of the pond and I am no wiser where it is after numerous phone calls to Parcelforce and Royal Mail. Too much time has elapsed to make a Paypal claim (45 days). The seller agreed to free postage. Who loses out?

Always difficult but the seller should wear the loss, although a lot have a different view. You purchased an item "delivered", that's the reality.

I've had items delivered from the USA to Italy after two, even three months in one circumstance. You should not loose hope yet.

I' m new here but I've sold lots of pens on FPN.
I always send pens registered with full insurance and tracking code because it's the risk of the seller when a pen disapear. Just my opinion...

I am the seller in this transaction. The pen was sent registered signature delivery. The tracking information shows it has left USPS hands & is now in RM possession. I believe I have fulfilled my end of the transaction by shipping it with tracking information. I don't believe I should be held responsible for the loss, if in fact that is what happened, it may just be hung up in customs or something similar. I called the post office and they said it's out of their hands & on RM to deliver. It truly sucks that it hasn't arrived yet but IDK what else i can do.

Offer to split the loss, offer another pen, offer a discount, offer any of myriad of possibilities.

These kinds of situations are always difficult. It seems to me that the postal carrier last receiving the item is at fault should the pen not be delivered. If the pen was shipped with tracking and a requested signature upon delivery, it is hard to fault the sender. At what point and date did the tracking last record the pen's whereabouts?

I do a lot of international purchases--I have most pens sent to my US address but sometimes have them shipped directly to me in the Philippines, where the wait from a US, EU or UK shipper can be as long as two months.

As has been noted, situations like these are always difficult to sort out. Based on just what I've read here, it would seem unfair to hold the seller liable in any way if he can prove that the item had left his hands and been received by someone on the other end. Some earlier provision should have been made, albeit at extra expense, for insurance, in the absence of which the buyer (as awful as the prospect is) might have to absorb the loss, as the shipper has no control over the shipment after its posting unless some special arrangement had been made (ie, express courier). I could very well be wrong but that's my honest take.

Let's hope the pen turns up miraculously on the buyer's doorstep one of these days. (And it isn't just the Royal Mail--USPS misdelivered a batch of about 15 pens, quite a number of them high-end and rare--to a neighbor in Virginia last month, and no one was even home so that box sat in their doorway for a week while my sister searched frantically for it, since the shipment had been marked DELIVERED in tracking. Thankfully she did a door-to-door search and found it. So stranger things have happened!)

OK.. I have been through this before as well...

Last Post Office to have it ... call them and ask for the Post Master. Give him the tracking info etc and ask him to look into it. He will know by the receiving address what carrier should have had it. They lock up those items at night when they are not delivered.

David N. has a nice breakdown of mailing options on his website, here. It would appear that registered is just very slow.
